Some Services are currently available only to individuals located in specific states.

Telemedicine refers to the delivery of healthcare services through electronic communications and information technology when the patient and provider are not in the same physical location. It may be used for diagnosis, treatment, follow-up care, and related patient education. Telemedicine interactions may include:
The technology systems used to provide these Services are equipped with security measures designed to protect the privacy and confidentiality of your health information.
For a full explanation of the potential risks and benefits of telemedicine, please review our Consent to Telehealth, which is incorporated into these Terms of Use by reference.
LifinityRx is committed to protecting the confidentiality and privacy of your health information. Please refer to the following documents for more details:
These documents are incorporated by reference into these Terms of Use.
LifinityRx does not provide medical care or clinical services, either through its Sites or otherwise. Instead, we offer a technology platform that enables you to connect with licensed healthcare providers affiliated with Beluga Health, P.A. or similar entities.
The information and tools offered through our Services are not intended to replace in-person medical care in all circumstances. Decisions regarding diagnosis or treatment remain between you and the licensed healthcare provider you consult.
By using the Services, you understand and agree that you are not establishing a provider–patient relationship with LifinityRx. You also consent to receive communications, notices, and disclosures from LifinityRx, its affiliates, and the affiliated healthcare providers. It is your responsibility to review these communications and to follow up as needed regarding treatment and care.
By opting in to receive SMS (text) messages from LifinityRx—or by initiating a text to us—you consent to receiving transactional and promotional messages related to your account and use of the Services. By doing so, you confirm that:
Your access to LifinityRx Services is not contingent on agreeing to receive marketing messages. You may opt out of SMS communications at any time by replying “STOP” to any text message received. For support, email us at care@lifinityrx.com.
Please be aware that text messages and emails are not encrypted and may be subject to interception by third parties. If you choose to send or receive sensitive health information via these channels, you do so at your own risk.
Healthcare providers affiliated with Beluga Health, P.A. may use the LifinityRx platform to deliver consultation, advice, or treatment. These providers may not have the benefit of conducting a physical examination, which can limit their understanding of your condition. To reduce risk, it is your responsibility to share accurate, complete, and relevant health information with your provider.
By using these Services, you acknowledge the inherent limitations of telemedicine and accept the associated risks. Diagnoses made through telehealth may be preliminary, and in some cases, telemedicine may not serve as a substitute for in-person care. For more details, please visit www.lifinityrx.com.

To access the Services, you must register for a LifinityRx account. Registered users (“Secure Users”) are required to provide accurate, current, and complete information, and to update it as necessary. Providing false or incomplete information may result in suspension or termination of your account.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. The App is designed for use only on mobile devices with unmodified operating systems. Using the App on a “jailbroken” or otherwise modified device may disable built-in security protections and compromise the confidentiality of your protected health information. Such use constitutes a material breach of these Terms of Use.

You agree not to:
Except for personal information protected under our [Privacy Policy] and applicable privacy laws (including HIPAA, where relevant), any information you submit through the Sites is considered non-confidential and becomes the property of LifinityRx and its affiliated entities. These Terms remain in effect while you access or use the Sites or Services. You may discontinue use at any time. LifinityRx reserves the right to suspend or terminate your access to the Sites or Services at its sole discretion, with or without notice.
Upon termination, all provisions that by their nature should survive—such as those related to disclaimers, limitations of liability, indemnification, governing law, and severability—shall remain in effect.
Your use of the Sites and Services is at your own risk. The Sites and Services are provided on an “as is” and “as available” basis. LifinityRx and its affiliates disclaim all warranties, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Services will be uninterrupted, secure, error-free, or meet your expectations.
To the fullest extent permitted by law, LifinityRx and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, arising out of or related to your use of (or inability to use) the Sites or Services—even if we have been advised of the possibility of such damages.
You agree to indemnify, defend, and hold harmless LifinityRx, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses—including reasonable legal fees—arising out of or related to your misuse of the Sites or Services, violation of applicable law, or intentional misconduct.
LifinityRx reserves the right to modify, suspend, or discontinue any part of the Sites or Services at any time, with or without notice, and without liability to you or any third party.
If a prescription is issued as part of your care, you may choose to have it filled through LifinityRx or a participating pharmacy within the LifinityRx Pharmacy Network. By doing so, you consent to the necessary sharing of your information with these pharmacy partners to facilitate fulfillment. Please note that prescriptions may not be provided in child-resistant packaging unless specifically required by law.
You agree to pay all fees associated with the Services you request, including fees charged by healthcare providers delivering care through the LifinityRx platform. If your selected payment method fails, you are responsible for providing an alternative method of payment in a timely manner.
Services provided through LifinityRx are generally not covered by federal or state healthcare programs (such as Medicare or Medicaid). By using the Services, you confirm that you are responsible for full payment and understand that affiliated providers will not submit claims to these programs on your behalf.
By accessing or using the Sites, you agree that the laws of the State of Delaware, without regard to conflict of laws principles, shall govern these Terms and any dispute arising from or relating to your use of the Services.
Except for claims related to intellectual property or requests for injunctive or equitable relief—which may be brought in the courts of New York, NY—any dispute shall be resolved through final and binding arbitration administered by the American Arbitration Association (AAA) in New York, NY, under its applicable rules.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
Failure by LifinityRx to enforce any right or provision in these Terms shall not be considered a waiver of that right or provision.
Nothing in these Terms shall be construed as creating a partnership, joint venture, employment, or agency relationship between you and LifinityRx.
Your breach of these Terms may cause LifinityRx irreparable harm, for which monetary damages may be insufficient. In such cases, LifinityRx reserves the right to seek injunctive or other equitable relief in addition to any other remedies available at law.
You may not assign, delegate, or transfer your rights or obligations under these Terms without prior written consent. LifinityRx may freely assign its rights and obligations at its sole discretion.

By clicking “I Agree,” you confirm that you have read and understood the information below, acknowledge the potential risks and benefits of asynchronous telemedicine, and voluntarily give your informed consent to participate in such care.
Telemedicine enables the delivery of healthcare services—such as exams, consultations, diagnoses, and treatments—through electronic communication when the patient and provider are in different locations.
Asynchronous (or “store-and-forward”) telemedicine involves the exchange of medical information without real-time interaction. You may submit data (such as text, images, or videos) for review by a provider at a later time.
The Beluga platform supports:
All care decisions are made at the discretion of the licensed healthcare provider. They will determine whether asynchronous telemedicine is appropriate for your needs. Participation does not guarantee a diagnosis, treatment, or prescription.
You consent to receive communications related to your care—including by phone, email, or text—from LifinityRx or its affiliated providers. Standard message and data rates may apply. You may revoke this consent by emailing care@lifinityrx.com.
This Informed Consent will remain in effect for the duration of your treatment through the Beluga platform, unless and until you choose to revoke it in writing.
